under the brand “Chicks N Tricks”.
For the purposes of these GTC, a consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or self-employed professional activity.
2. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.
By submitting an order, you make a binding offer to conclude a purchase contract.
The contract is concluded once we accept your order by sending an order confirmation via email or by dispatching the goods.
3. Prices and Payment Terms
All prices stated are final prices in euros and include the applicable statutory value-added tax (VAT).
Any additional shipping costs will be indicated separately during the ordering process.
Payment shall be made using the payment methods offered in the shop.
4. Delivery and Shipping
Delivery is made to the address specified by the customer.
Delivery times are stated in the respective offer.
In the case of consumers, the risk of accidental loss or accidental deterioration of the goods passes to the customer only upon delivery of the goods.
5. Retention of Title
The goods remain our property until full payment has been received.
6. Right of Withdrawal
Consumers are entitled to the statutory right of withdrawal.
Details are set out in our separate cancellation policy.
7. Liability for Defects (Warranty)
The statutory provisions on liability for defects shall apply.
The limitation period for defect claims for new goods is two years from delivery of the goods.
8. Liability
We shall be fully liable:
-
in cases of intent and gross negligence
-
for injury to life, body, or health
-
under the provisions of the German Product Liability Act
In cases of slight negligence involving a breach of essential contractual obligations (cardinal obligations), liability shall be limited to the foreseeable damage typical for the contract.
Any further liability is excluded.
9. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR).
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
10. Applicable Law
German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
With regard to consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence.
